    Conditions for the provision of services between FERRY IBIZA and the USERS


    01.- Terms and Conditions. PRE-HIRING INFORMATION



    1.1. These Terms and Conditions together, where appropriate, with the particular conditions that may be established, will expressly regulate the relations arising between FERRY IBIZA, registered trademark of I LOVE VIAJES, (commercial name of Javier Blanco Ibarreta), NIF 18.601.319T, (of hereinafter FERRY IBIZA) and third parties (hereinafter "Users") who contract the provision of services or products offered through the Web.



    1.2. These General Conditions have been prepared in accordance with the provisions of Law 34/2002, on services of the information society and electronic commerce, Law 7/1998 on Terms and Conditions, Royal Decree 1906/1999 by which Telephone or electronic contracting is regulated with general conditions in the development of article 5.3 of Law 7/1998, Law 26/1984 General for the Defense of Consumers and Users, Law 7/1996 on the Regulation of Retail Trade, the Real Decree-Law 14/1999 regulating the Electronic Signature and any applicable legal provisions.



    1.3. For the use and/or provision of any of the services of the Web, they imply the acceptance as a User, without reservations of any kind, to each and every one of the Terms and Conditions, of the General Conditions of Use of the Web as well as in your case, to the Particular Conditions that, in your case, govern the acquisition.



    1.4. FERRY IBIZA informs that the procedures to carry out the acquisition of goods and/or obtain the provision of the services offered, are those that are described in these general conditions, as well as those other specific ones that are indicated on the screen during navigation, so that the User declares to know and accept said procedures as necessary to access the products and services offered on the Web.



    1.5. All the information provided during the contracting process will be stored by FERRY IBIZA and/or its suppliers in such a way that the User may, upon request made in writing or by e-mail, request information regarding the operations carried out by him within 6 months. previous. Any modification and/or correction of the data provided by the Users during navigation must be carried out according to the indications included in the Web.



    1.6. Users who contract services through the FERRY IBIZA website state that they are of legal age (18 years). In case of contracting by minors, authorization from parents or guardians is required to be able to enjoy the contracted service.



    02.- CONTRACT OF CARRIAGE



    2.1. Passengers without a vehicle must present themselves for boarding at least 60 minutes before the departure of the ship, while passengers boarding with a vehicle must do so at least 90 minutes before. Except on the Valencia – Mostaganem line (Algélia), which must be present 4 hours before the ship's departure. If boarding passes are not available beforehand, within these limits, the Company reserves the right to freely dispose of the space assigned to the passenger or vehicle.



    2.2. Boarding passes / tickets and are personal and non-transferable. The license plate of the vehicle to be transported must be the one that appears on the boarding passes / tickets. The passenger without a vehicle on board has the right to transport the baggage that can be transported in a single trip and by himself from the Maritime Station to his accommodation inside the ship. If you carry more luggage, you must contact a transport company, a service offered by shipping companies. If you do not meet these requirements, the shipping companies can deny you boarding without the possibility of reimbursement.



    2.3.FERRY IBIZA and the shipping companies are not responsible for possible theft and/or loss of luggage or personal belongings of passengers. Passengers are advised to carry valuables with them.



    2.4. Any claim, to be admitted, must be accompanied by the reservation documentation, accepting all the conditions that appear in it for the sole fact of having been used as a transport ticket.



    2.5. The passenger may obtain a refund of the amount of the ticket from the shipping companies, in case of not making use of it, and provided that the contracted rate allows it, in accordance with the following conditions:


    a). After deducting from the advance sale 10 percent of the amount of the ticket, if the request is presented within 7 days before the departure of the ship.


    b). For refunds submitted within 48 hours and before 2 hours prior to the departure of the ship, 20 percent of the amount of the ticket will be deducted.


    c). Tickets presented to be canceled and/or modified less than two hours before the departure of the ship will not be reimbursed, whether the reservation has been made on the same day of departure, or before.



    2.6.All BALEARIA fares and "mini" offers allow changes of date and/or time of travel with a penalty of €20 per reservation plus the possible increase in the rate, if any, as long as the change is made within 2 hours prior to the date and time of departure of the initially contracted trip. The full and "reduced" fare of BALEARIA allow changes without penalty of €20 but there could be an increase in the fare from one date to another, as long as they are made within 2 hours prior to the departure date and time of the initially contracted trip.



    2.7. Schedules and itineraries may be subject to variations due to breakdowns, fortuitous events or force majeure. In such cases, BALEARIA will adopt the measures under its control to notify the affected passengers of said variations. In case of necessity motivated by the previous causes, the shipping company can be replaced by a ferry company or use other ships.



    2.8. In the event that the contracted trip is not carried out, due to breakdown, fortuitous event or force majeure, the ferry company assumes no more responsibility than the obligation to reimburse the full amount of the ticket.



    2.9. Passengers who do not board, for any reason beyond BALEARIA's control, will not be entitled to a refund of the amount of the ticket.



    2.10. The tickets issued OPEN (open return) of BALEARIA are valid for one year from the date of issue, their use being subject to the prior reservation of a place. The contracted rate will be maintained until January 15 of the following year. After this date, the return can be closed by paying the supplement corresponding to the year's rate increase.



    2.11. The transport of vehicles covered by this ticket is carried out in accordance with current regulations on the matter and by international agreements signed by Spain.



    2.12. For the exercise of actions derived from this ticket in national cabotage navigation lines, the jurisdiction that results from applying the Civil Procedure Law in force will be applied. When maritime transport is carried out on international lines, it will be subject to the jurisdiction of the Courts resulting from the application of the 1974 Athens Convention and/or the instruments that modify it.



    2.13. The passenger has the right to withdraw from the contract related to passenger transport within a period of 14 calendar days without the need for justification. The withdrawal period will expire 14 calendar days after the conclusion of the contract.


    To exercise the right of withdrawal, the passenger must notify the company (inserting his name, his full address and, if available, his telephone number, his fax number and his email address) his decision to withdraw from the contract through an unequivocal statement (for example, a letter sent by post, fax or email).


    To comply with the withdrawal period, it is sufficient that the communication regarding the exercise by you of this right is sent before the corresponding period expires.


    Consequences of withdrawal:


    In case of withdrawal by the passenger, the company will return all payments received from the passenger's transport, including delivery costs (with the exception of additional costs resulting from the choice on your part of a delivery method other than the one least expensive mode of ordinary delivery offered) without undue delay and, in any case, no later than 14 calendar days from the date on which you are informed of your decision to withdraw from your contract.


    The company will proceed to make said reimbursement using the same means of payment used by the passenger for the initial transaction, unless it has expressly provided otherwise; in any case, you will not incur any expenses as a result of the reimbursement.



    03.- SERVICES OFFERED. ACCESS TO SERVICES.



    3.1. The Services offered on the Web -publication of information and sale of tickets online- will be governed both by the provisions of these General Conditions and, especially, by the provisions of the Particular Conditions set for each of these services.



    3.2. In order to access the provision of some of the services offered through the Web, you can provide the User with a Username and a secret code ("Password"). The Username and Password provided by FERRY IBIZA to the User are identifying and enabling elements to access the services and are personal and non-transferable. FERRY IBIZA may, with due notice, make changes to the User Name and/or password, in which case the modified passwords will lose their validity.



    3.3. All the means and technical requirements that are needed to access the Website and the services offered therein will be for the exclusive account of the User, as well as any expenses or taxes to which the provision of said services may give rise.



    3.4. Once you have accessed, and to proceed to the use of the different services, the User must follow all the indications and instructions on the screen, completing for this purpose the Particular Conditions and other forms set for each service, which will mean the reading and acceptance of all the general conditions established in the General Conditions of Use of the Web, in these Terms and Conditions, as well as, where appropriate, the Particular Conditions that may be applicable.



    04.- APPLICABLE LEGISLATION. SUBMISSION TO JURISDICTION.



    4.1. This contract will be governed by Spanish legislation, which will be applicable in matters not provided in this contract in terms of interpretation, validity and execution.
